Terms of Service

1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of TrueCourse's Google Workspace Add-on and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
If you are using the Service on behalf of an organization (such as a driving school), you represent that you have the authority to bind that organization to these Terms, and "you" refers to that organization.
IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SERVICE.
2. Description of Service
TrueCourse provides a Google Workspace Add-on designed for driving schools in Maine to:
- Generate New Course Reports (NCR) and Course Completion Reports (CCR) for Maine BMV compliance
- Manage student rosters and session schedules
- Create and manage Google Forms registration workflows and import CSV rosters
- Check Session Dates and track compliance requirements
The Service integrates with Google Docs, Google Sheets, Google Forms, and Google Drive to provide these features.
3. Account Registration and Eligibility
3.1 Eligibility
You must be at least 18 years old and have the legal capacity to enter into contracts to use the Service. The Service is intended for business use by driving schools and their authorized staff.
3.2 Google Account
To use the Service, you must have a valid Google Workspace or Google account. You are responsible for maintaining the confidentiality of your Google account credentials.
3.3 Account Security
You are responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other security breach.
4. Subscription Plans and Billing
4.1 Subscription Tiers
We offer multiple subscription tiers (Basic, Essential, Pro) with different features and usage limits. Current pricing and features are available on our Pricing page.
4.2 Payment
Subscription fees are billed in advance based on your chosen plan, typically monthly unless otherwise stated. Payment is processed through Stripe, a third-party payment processor. By providing payment information, you authorize us to charge your payment method for all fees.
4.3 Automatic Renewal
Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current rate for your plan.
4.4 Cancellation
You may cancel your subscription at any time through your account settings or by contacting us. Cancellations take effect at the end of your current billing period. No refunds or credits will be provided for partial billing periods.
4.5 Price Changes
We reserve the right to modify subscription prices at any time. We will provide you with at least 30 days' notice before any price increase takes effect. Your continued use of the Service after a price change constitutes acceptance of the new pricing.
4.6 Taxes
All fees are exclusive of applicable taxes, duties, or similar governmental assessments. You are responsible for paying all such taxes except those based on our net income.
5. Usage Limits and Restrictions
5.1 Plan Limits
Your use of certain features is subject to the limits of your subscription tier (e.g., number of locations, included reports or credits, and access to certain features). Exceeding these limits may require upgrading to a higher tier.
5.2 Acceptable Use
You agree NOT to:
- Use the Service for any illegal purpose or in violation of any laws
- Attempt to gain unauthorized access to the Service or related systems
- Interfere with or disrupt the Service or servers
- Use automated scripts or bots to access the Service in ways not intended
- Reverse engineer, decompile, or disassemble any part of the Service
- Remove, obscure, or alter any proprietary notices (copyright, trademark, etc.)
- Resell, sublicense, or provide the Service to third parties without authorization
- Use the Service in a manner that violates Google's Terms of Service or API policies
5.3 Data Usage
You are responsible for ensuring that any student data, personal information, or other content you process through the Service complies with all applicable privacy laws and regulations, including FERPA (Family Educational Rights and Privacy Act) if applicable.
6. Intellectual Property Rights
6.1 Our Rights
The Service, including all software, code, designs, text, graphics, and other content (excluding Your Content as defined below), is owned by or licensed to TrueCourse. All rights, title, and interest in and to the Service are and will remain our exclusive property.
6.2 Your Content
You retain all rights to any data, documents, or content you create, upload, or process using the Service ("Your Content"). By using the Service, you grant us a limited license to access, use, and process Your Content solely to provide the Service to you.
6.3 Feedback
If you provide us with any feedback, suggestions, or ideas about the Service, you grant us the right to use such feedback without any obligation to you.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that:
- The Service will meet your requirements or expectations
- The Service will be available at any particular time or location, uninterrupted or secure
- Any defects or errors will be corrected
- The Service is free of viruses or other harmful components
- Results generated by the Service (such as reports) will be accurate or compliant with Maine BMV requirements
Important: While we strive to assist with Maine BMV compliance, you are solely responsible for ensuring that all reports, forms, and documentation meet current BMV requirements and regulations. We recommend reviewing all generated documents before submission.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TRUECOURSE, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
This includes, but is not limited to, damages for:
- Loss of profits, revenue, or data
- Business interruption
- Loss of goodwill
- Regulatory fines or penalties resulting from errors in generated documents
- Any other intangible losses
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.
9. Indemnification
You agree to indemnify, defend, and hold harmless TrueCourse and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use or misuse of the Service
- Your violation of these Terms
- Your violation of any third-party rights, including privacy rights
- Your Content or any data you submit, post, or transmit through the Service
- Any disputes between you and students, parents, or regulatory agencies
10. Data and Privacy
Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.
Important — We Do Not Store Student Data: TrueCourse does not collect, store, or have access to student personal data. Student rosters, Students, and enrollment data remain entirely in your Google Drive and Google Workspace account. While you may work with student information in your Google Sheets and Forms, that data is never transmitted to or stored on our servers.
Your Responsibility for Data Compliance: As the school and data controller, you are responsible for:
- Complying with all applicable privacy laws (FERPA, GDPR, etc.) for any student or educational data you manage in your Google Workspace
- Obtaining all necessary consents from students or their guardians for data you collect and process
- Ensuring the accuracy and lawfulness of any student data you enter into your own Google Sheets, Forms, or Docs
- Securing your Google Workspace account and managing access to student data appropriately
11. Third-Party Services and Links
The Service integrates with third-party services, primarily Google Workspace (Google Docs, Sheets, Forms, Drive). Your use of Google services is subject to Google's Terms of Service and Privacy Policy.
Our Service may contain links to third-party websites or services that we do not own or control. We are not responsible for the content, privacy policies, or practices of any third-party sites or services.
12. Termination
12.1 By You
You may terminate your subscription at any time by canceling through your account settings or contacting us. Termination will be effective at the end of your current billing period.
12.2 By Us
We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including if you:
- Breach these Terms
- Fail to pay subscription fees
- Engage in fraudulent or illegal activity
- Violate Google's Terms of Service or API policies in a way that affects our Service
12.3 Effect of Termination
Upon termination:
- Your right to use the Service will immediately cease
- We may delete your account data after a reasonable retention period
- You remain responsible for any fees incurred before termination
- Sections of these Terms that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will continue to apply
Data Export: We recommend exporting any important data before terminating your account. Your Google Drive files (Docs, Sheets, Forms) created through the Service will remain in your Google Drive.
13. Changes to the Service and Terms
13.1 Service Modifications
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance.
13.2 Terms Modifications
We may update these Terms from time to time. If we make material changes, we will notify you by:
- Posting the updated Terms on this page
- Updating the "Last Updated" date
- Sending an email notification (if you have provided an email address)
Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the new Terms, you must stop using the Service and cancel your subscription.
14. Dispute Resolution and Governing Law
14.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Maine, United States, without regard to its conflict of law provisions.
14.2 Dispute Resolution
Any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except that:
- Either party may seek injunctive relief in court for intellectual property or confidentiality matters
- Small claims court may be used for disputes within its jurisdiction
14.3 Class Action Waiver
You agree to resolve disputes with us only on an individual basis, and not as part of any class, consolidated, or representative action.
15. General Provisions
15.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and TrueCourse regarding the Service and supersede all prior agreements.
15.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
15.3 Waiver
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
15.4 Assignment
You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.
15.5 Force Majeure
We will not be liable for any delay or failure to perform due to causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, or Internet service failures.
15.6 No Agency
Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and TrueCourse.
